Abstract
The article is devoted to the analysis of formal institutional limitations in the contemporary Russian legislation, which are interpreted as conditions of functioning of the higher education. The authors examine how the changes of these limitations could influence on the system of the Russian higher education. The theory of institutes and institutional amendments by D. Nort has been used in the article for the analysis of formal institutional restrictions.
