Abstract
The article presents the comparative and legal research of the employers’ power manifestation in the social and labor relations as well as in the social partnership in Russia and foreign countries. The particular attention is paid to Germany. A comparative analysis considering legal and regulatory frameworks of the foreign countries and its social partnership system is carried by the author. The author gives own point of view on the issue of independence of an employee, based on foreign countries’ experience in the system of social partnership.
