Abstract
In the present article shortcomings of a modern state regulation of voluntary refusal from a crime in interrelation with provisions of the Russian criminal law about participation are considered. The way of overcoming discrepancy between a state encouragement of voluntary termination of criminal activity and guarding and precautionary function of the right is offered.
